As a consequence of our environmental, toxic tort and insurance work, we have experience in many areas of construction and construction law, including sewer and other underground construction, building defect and sick building claims, contract and indemnity claims, and construction delay claims. The firm is experienced with construction project documents and litigating complex construction claims.

Our experience dates to 1981 with analysis of insurance obligations associated with multiple condominium construction defects. Litigated construction matters have included major hospital construction, sewer and other underground construction, golf course construction, commercial and residential mold and indoor air issues, and real estate claims. Other construction-related issues have involved manufacturing plants, chemical blending and processing plants, plating plants, wastewater treatment plants, gas stations, manufactured gas plants, and religious institutional construction.

Mr. Kelley represented a commercial client as added co-counsel in a protracted construction arbitration resulting in a $2 million recovery for the subcontractor client. Mr. Kelley presented on the respective roles of construction contractors and construction managers as a part of "Construction Contracting for Public Entities in Michigan" sponsored by Lorman Education Services.
